Dans une telle transaction impliquant propri\u00e9taires, locataires et courtiers, comment faire valoir les droits de chacun ?<br \/>\nEn suivant un <a href=\"https:\/\/www.oaciq.com\/fr\/pages\/lois-et-reglements\" target=\"_blank\">code d\u00e9ontologique<\/a> pr\u00e9cis, le courtier se doit de traiter \u00e9quitablement toutes demandes provenant autant des locataires que des propri\u00e9taires. Il doit dans un premier temps communiquer avec les occupants du logement et les informer du souhait de vente du propri\u00e9taire. Le r\u00f4le ultime du courtier est de s\u2019assurer du bon d\u00e9roulement de cette transaction pour les deux parties. Si les relations entre propri\u00e9taire et locataire sont d\u00e9j\u00e0 tendues, le courtier se positionne alors comme m\u00e9diateur et essaye au mieux d\u2019apaiser la situation.<\/p>\n<p>La plus grosse ambigu\u00eft\u00e9 dans ces circonstances est de coordonner les visites dans des logements encore occup\u00e9s par les locataires qui n\u2019ont pas leur mot \u00e0 dire sur la vente. Bien que dans la plupart des cas la collaboration soit fructueuse, certains locataires \u00e9prouvent une certaine r\u00e9ticence \u00e0 laisser entrer des inconnus dans ce qui est encore leur chez-soi.<\/p>\n<p>L\u2019intervention du courtier est alors essentielle. Avec le locataire, ils se mettent d\u2019accord sur des droits de visite, moyennant un pr\u00e9avis de 24 heures \u00e9tabli par la loi. Il est du devoir du locataire de se plier face \u00e0 la d\u00e9cision de vente du propri\u00e9taire. Il est aussi de son devoir d\u2019autoriser des visites et de fixer des horaires avec le courtier.<\/p>\n<p>Dans les faits, cette \u00e9tape se d\u00e9roule bien. Certains locataires laissent m\u00eame les cl\u00e9s de leur logement si une visite est programm\u00e9e alors qu\u2019ils ne seront pas pr\u00e9sents. Le souci premier du courtier est alors d\u2019\u00e9tablir une relation de confiance avec le locataire.<\/p>\n<p>Dans un sc\u00e9nario oppos\u00e9, un locataire peut se consid\u00e9rer comme victime ou ne pas \u00eatre satisfait de la mani\u00e8re dont les choses se d\u00e9roulent. Dans le cas pr\u00e9sent, c\u2019est son droit de demander recours.
