Voici quelques r\u00e9ponses \u00e9clairantes.<\/p>\n<div class=\"entry chapitre chapitreTexte\">\n<p><strong>Aucun d\u00e9lai<\/strong><\/p>\n<p>\u00c0 la suite de la signature d&#8217;un bail, un locataire ne dispose d&#8217;aucun d\u00e9lai pour l&#8217;annuler.<\/p>\n<p><strong>Trois ans<\/strong><\/p>\n<p>Si un locataire d\u00e9guerpit de son logement et qu&#8217;il est retrac\u00e9 par son propri\u00e9taire, ce dernier a trois ans pour d\u00e9poser \u00e0 la R\u00e9gie du logement une demande r\u00e9clamant au locataire le loyer impay\u00e9.<\/p>\n<p><strong>Propri\u00e9taire occupant<\/strong><\/p>\n<p>Un propri\u00e9taire a le droit de ne pas renouveler le bail de son locataire \u00e0 la condition d&#8217;occuper lui-m\u00eame l&#8217;appartement, ou de le louer \u00e0 son p\u00e8re, \u00e0 sa m\u00e8re, \u00e0 ses enfants ou \u00e0 tout autre parent dont il est le principal soutien. Le propri\u00e9taire doit alors donner un avis \u00e9crit au locataire au moins six mois avant la fin du bail, s&#8217;il s&#8217;agit d&#8217;un bail d&#8217;un an. Le locataire a un mois pour r\u00e9pondre. Si le locataire n&#8217;accepte pas par \u00e9crit, le propri\u00e9taire devra produire une Demande de reprise du logement \u00e0 la R\u00e9gie du logement.<\/p>\n<p><strong>Renouvellement automatique<\/strong><\/p>\n<p>Au Qu\u00e9bec, la loi est ainsi faite qu&#8217;un bail de logement se renouvelle automatiquement sans que le propri\u00e9taire ou le locataire soient oblig\u00e9s d&#8217;\u00e9changer d&#8217;avis, sauf s&#8217;il y a des modifications au bail.<\/p>\n<p><strong>Modifications<\/strong><\/p>\n<p>Si le propri\u00e9taire veut modifier le bail, il doit donner un avis \u00e9crit au locataire pour l&#8217;informer des modifications. Il y a des d\u00e9lais \u00e0 respecter. Pour un bail \u00e0 dur\u00e9e fixe de 12\u00a0mois ou plus\u00a0: entre trois et six mois avant la fin du bail; pour un bail \u00e0 dur\u00e9e fixe de moins de 12\u00a0mois\u00a0: entre un et deux mois avant la fin du bail; pour un bail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e\u00a0: entre un et deux mois avant la modification demand\u00e9e. Cet avis doit \u00eatre \u00e9crit et indiquer clairement les modifications propos\u00e9es au renouvellement du bail, qu&#8217;il s&#8217;agisse du loyer ou d&#8217;autres conditions, la dur\u00e9e du bail, par exemple, ou la suppression du droit d&#8217;utiliser la cour ou le stationnement.<\/p>\n<p><strong>R\u00e9ponse \u00e0 l&#8217;avis<\/strong><\/p>\n<p>Le locataire doit r\u00e9pondre \u00e0 cet avis s&#8217;il refuse l&#8217;augmentation ou la modification propos\u00e9e, ou s&#8217;il d\u00e9sire quitter le logement \u00e0 la fin du bail. Il doit r\u00e9pondre dans un d\u00e9lai d&#8217;un mois \u00e0 compter de la date de r\u00e9ception de l&#8217;avis. Le fait de ne pas r\u00e9pondre \u00e0 un avis de modification de bail dans le mois de sa r\u00e9ception \u00e9quivaut \u00e0 la reconduction du bail, donc \u00e0 son renouvellement avec toutes les modifications demand\u00e9es par le propri\u00e9taire, incluant l&#8217;augmentation du loyer.<\/p>\n<p><strong>Augmentation refus\u00e9e<\/strong><\/p>\n<p>Si le locataire accepte le renouvellement de son bail, mais refuse l&#8217;augmentation de loyer ou les modifications propos\u00e9es, le propri\u00e9taire dispose d&#8217;un d\u00e9lai d&#8217;un mois, \u00e0 compter de r\u00e9ception de la r\u00e9ponse du locataire, pour produire \u00e0 la R\u00e9gie du logement une demande afin de fixer le loyer ou de statuer sur les modifications demand\u00e9es.
